PENALTY GROUPS AND FELONY DRUG CHARGES

The Texas Controlled Substances Act defines “Penalty Groups” to determine the severity of drug crimes.

CONTROLLED SUBSTANCE PENALTY GROUPS[1]:

  • 1 includes heroin, cocaine, methamphetamine, oxycodone, and hydrocodone.
  • 1A contains LSD as a sub-group of Penalty Group 1, carrying higher punishments for large quantities.
  • 2 considers drugs like psilocybin, ecstasy, PCP, hashish, marijuana oil and concentrates.
  • 3 and 4 includes drugs such as Xanax, Valium, Ritalin, and buprenorphine.

TEXAS DRUG CHARGES AND PENALTIES THAT YOU SHOULD KNOW

PENALTY GROUP ONE

Less than one gram of possession of a Penalty Group 1 substance is a state jail felony. 1 to less than 4 grams is a third-degree felony, and 4 to 200 grams is a second-degree felony.  Possession of more than 200 grams is a first-degree felony with a possible 99-year sentence.  Possession of more than 400 grams constitutes an enhanced first-degree felony, and raises the minimum sentence to 10 years, and the fine to up to $100,000.  Group 1A, or LSD possession penalties allow for an increased minimum sentence of fifteen years and a fine up to $250,000.

PENALTY GROUP TWO

Penalty Group 2 charges increase in the same quantity proportions, but the charges and punishments are somewhat less severe.  Although this group does not include a first-degree charge, possession of more than 400 grams can bring enhanced first-degree felony charges.

PENALTY GROUPS THREE AND FOUR
